Welcome to Nuevo Coastal. These Terms & Conditions govern your access to and use of nuevocoastal.com (the “Website”).

By accessing or using the Website, you agree to these Terms & Conditions. If you do not agree with them, please do not use the Website.

1. About Nuevo Coastal

Nuevo Coastal is a real estate marketing and information website operated by NUEVO COASTAL REAL ESTATE.

Nuevo Coastal focuses on coastal real estate in Mexico, including Cabo San Lucas, San José del Cabo, Baja California Sur, and other coastal communities.

Nuevo Coastal is a marketing and informational platform. It is not itself a real estate brokerage, law firm, financial advisory firm, tax advisory firm, or investment advisory firm.

Information provided through the Website is for general informational and marketing purposes only. It does not constitute legal, financial, tax, investment, immigration, or real estate advice.

2. Guillermo “Memo” Calderón

Guillermo Calderón de Rueda, commonly known as “Memo,” is the featured real estate professional associated with Nuevo Coastal.

Nuevo Coastal may market Memo’s services, display properties and market information associated with him, and direct property inquiries to him or to another real estate professional or brokerage identified in connection with a particular listing.

Any brokerage, representation, negotiation, transaction, or other professional real estate service is provided separately by the real estate professional, brokerage, developer, or property representative identified in connection with the service.

Use of the Website or submission of an inquiry does not automatically create an agency, brokerage, fiduciary, representation, or professional relationship. Any such relationship must be established separately through an appropriate written agreement.

3. Permitted Use of the Website

You agree to use the Website only for lawful purposes and in accordance with these Terms.

You may not:

  • Violate any applicable law or regulation.

  • Interfere with the operation, performance, or security of the Website.

  • Attempt to gain unauthorized access to the Website, its server, accounts, systems, or data.

  • Introduce viruses, malicious code, or other harmful material.

  • Use automated tools, bots, crawlers, scraping technologies, or data-extraction methods without prior written permission.

  • Submit false, misleading, fraudulent, or impersonating information.

Listing information may be supplied by participating multiple listing services, listing brokers, real estate professionals, developers, property owners, Flexmls/FBS, or other third-party sources.

Although we make reasonable efforts to present useful and current information:

  • Properties may be sold, rented, withdrawn, reserved, or otherwise become unavailable without notice.

  • Prices and terms may change without notice.

  • Photographs may not reflect a property’s current condition.

  • Measurements, features, boundaries, taxes, fees, rental projections, and other details may be approximate.

  • Listing information may contain errors, omissions, delayed updates, or inaccuracies.

Nuevo Coastal does not independently guarantee the accuracy, completeness, legality, condition, availability, or suitability of any property or listing information.

Users should independently verify all material information through the appropriate real estate professional, property owner, developer, attorney, accountant, inspector, lender, notary, or governmental authority before making a decision or entering into a transaction.

5. Properties and Transactions in Mexico

The purchase, sale, lease, financing, ownership, and use of property in Mexico may be subject to Mexican federal, state, and local laws, regulations, taxes, permits, trust requirements, notarial procedures, contractual terms, and other legal requirements.

Nuevo Coastal does not provide legal, tax, immigration, accounting, financing, inspection, appraisal, or title services.

Prospective buyers, sellers, renters, and investors should obtain independent professional advice from qualified professionals familiar with the location and transaction involved.

Any estimates concerning appreciation, rental income, return on investment, taxes, expenses, or future value are illustrative only and are not guarantees of future performance.

6. Third-Party Real Estate Professionals and Services

Nuevo Coastal may introduce or connect users with real estate professionals, brokerages, developers, lenders, attorneys, accountants, inspectors, property managers, notaries, escrow providers, title professionals, contractors, or other third parties.

Unless expressly stated otherwise in writing, these third parties operate independently and are not employees, agents, partners, or representatives of Nuevo Coastal.

Nuevo Coastal does not control and is not responsible for:

  • Advice or representations provided by third parties.

  • Property inspections, appraisals, surveys, or title reviews.

  • Financing, escrow, trust, or payment arrangements.

  • Contracts, negotiations, deposits, closings, or property transfers.

  • The condition, legality, ownership, development status, or permitted use of a property.

  • The actions, errors, omissions, qualifications, or availability of third-party professionals.

Any professional or business relationship entered into with a third party is governed by the agreement between you and that party.

7. Intellectual Property and Third-Party Content

The Nuevo Coastal name, logo, branding, original text, graphics, videos, layouts, and other content created for the Website are owned by or licensed to Nuevo Coastal and may be protected by copyright, trademark, and other intellectual-property laws.

However, property photographs, listing descriptions, listing data, maps, trademarks, logos, and other materials displayed through the Website may be owned by or licensed from participating MLS organizations, listing brokers, real estate professionals, developers, property owners, Flexmls/FBS, mapping providers, or other third parties.

Nothing on the Website transfers ownership of any intellectual property to you.

You may view Website content for personal, noncommercial property-research purposes. You may not reproduce, modify, distribute, republish, sell, scrape, sublicense, or commercially exploit Website content without prior written permission from the applicable rights holder.

Any MLS, IDX, brokerage, copyright, or listing attribution displayed with property information forms part of these Terms and must not be removed or obscured.

8. Inquiries and Other User Submissions

The Website may allow you to submit:

  • Contact inquiries.

  • Requests for property information.

  • Requests to arrange a viewing or consultation.

  • Feedback.

  • Reviews or testimonials, when applicable.

  • Other information that you voluntarily provide.

By submitting information, you represent that:

  • The information is accurate to the best of your knowledge.

  • You have the right to provide it.

  • Your submission does not violate any law or the rights of another person.

  • Your submission does not contain malicious code, unlawful material, or intentionally misleading information.

Submitting an inquiry does not, by itself, subscribe you to unrelated promotional communications or establish an agency or representation agreement. Marketing communications will be handled in accordance with applicable law and any consent choices presented to you.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Nuevo Coastal, its operator, owners, affiliates, contractors, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from:

15. Governing Law and Jurisdiction

These Terms and any dispute arising solely from access to or use of the Website will be governed by the laws of the State of California, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

Subject to any mandatory legal rights or jurisdictional requirements, disputes relating solely to Website use will be brought in the state or federal courts located in San Diego County, California.

This section does not determine the law governing the purchase, sale, lease, financing, ownership, or use of real estate in Mexico. Property transactions in Mexico remain subject to applicable Mexican law, the location of the property, and the separate contracts and professional agreements governing the transaction.

16. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

17. Entire Agreement

These Terms, together with the Privacy Policy and any notices or policies displayed on the Website, constitute the agreement governing general use of the Website.

They do not replace or modify any separate brokerage, representation, listing, purchase, sale, lease, financing, or other written agreement entered into with a real estate professional or third party.
